General Terms and Conditions for Orders at Weinkontor Sommer

§ 1 General Information, Scope of the Terms and Conditions
1.1 All deliveries and services provided by Weinkontor Sommer GmbH, represented by Managing Director Timm Sommer, Ostring 22, 76829 Landau (hereinafter referred to as “Weinkontor Sommer”), are exclusively subject to the following General Terms and Conditions in the version valid at the time of the order.

1.2 Customers within the meaning of these terms are both consumers and businesses. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activity. A business is any natural or legal person or partnership with legal capacity that acts in the course of their commercial or independent professional activity when concluding a contract.

§ 2 Conclusion of Contract
2.1 The product offerings in our online shop represent a binding offer to enter into a contract. You accept this offer by placing an order. The contract comes into effect once you send your order to us.

2.2 To place an order, simply browse the desired product by clicking on its name, image, or the “learn more” button. You can place it in your shopping cart by clicking “add to cart.” You can view the cart at any time by clicking [My Cart]. Items can be removed or quantities adjusted using [+] or [-].
To proceed, click [Checkout] in the cart view. During the process, you create an account, enter your details, and select a delivery and payment method. In the final step, under “Review Order,” you can verify and edit all your data before confirming. Errors can be corrected by navigating back or restarting the order.

To complete your purchase, you must accept our Terms and Conditions and click [Buy Now], which submits your order.

§ 3 Right of Withdrawal for Consumers
The following withdrawal right applies only to consumers:

Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without providing any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you (who is not the carrier) took possession of the last item.

To exercise your right, you must inform us (Weinkontor Sommer GmbH, Ostring 22, 76829 Landau in der Pfalz, Phone: +49 (0) 1512 - 61 69 51 4, Email: info@weinkontorsommer.de) by means of a clear declaration (e.g. letter or email). You may use the attached sample withdrawal form, but this is not mandatory.

To meet the deadline, it is sufficient to send the notification before the withdrawal period expires.

Consequences of Withdrawal
If you withdraw from this contract, we will refund all payments received from you, including delivery charges (except for any additional costs resulting from your choice of a non-standard delivery method), without undue delay and at the latest within fourteen days from the day we receive your notice. The refund will be made using the same payment method used in the original transaction unless otherwise agreed. You will not incur any fees.

We will collect the goods at our expense.

You are only liable for any diminished value if it results from handling not necessary to examine the nature, characteristics, and functioning of the goods.

Exemptions from the Right of Withdrawal
There is no right of withdrawal for contracts concerning sealed audio or video recordings or computer software if the seal has been removed.
The right of withdrawal does not apply to goods that spoil quickly or whose expiration date would be quickly exceeded.

§ 5 Prices and Shipping Costs
All prices include applicable VAT plus shipping. Shipping rates can be found in the product description. Shipping is handled directly by Weinkontor Sommer.

§ 6 Delivery Terms
6.1 We ship within Germany only. Delivery is via DPD, DHL, or another carrier of our choice.
6.2 Orders are dispatched within 3–5 days of receipt of payment, unless otherwise specified.
6.3 Our services are for adults only. Alcohol may not be ordered by anyone under 18. Goods will be delivered only to adults.

§ 7 Payment Terms
7.1 Payment methods: direct debit, PayPal, instant transfer, credit card. For direct debit or credit card, your account will be charged 1–2 days after the order. With PayPal or instant transfer, you will be redirected to the respective payment provider.
7.2 Goods remain our property until full payment is received.
7.3 If you are a consumer, default interest is 5% above the base rate. If you are not a consumer, it is 8%. We reserve the right to claim further damages.
7.4 By submitting your credit card details with the order, you authorize your provider to charge the full amount immediately.

§ 8 Storage of Contract Text
We store your order and order data. You will receive an order confirmation and a contract summary via email. You can print both the order and terms before submitting. Past orders are viewable in your customer account.

§ 9 Warranty
9.1 For consumers, statutory warranty rights apply.
9.2 For business customers:

• 9.2.1 Goods must be inspected immediately upon receipt. Defects must be reported without delay. Otherwise, goods are deemed accepted unless the defect was not detectable upon inspection.

• 9.2.2 We reserve the right to choose the form of remedy (repair or replacement). After three failed attempts, the remedy is considered unsuccessful.

• 9.2.3 We cover costs for remedy only if not increased by the goods being moved to a location other than the business’s registered address.

• 9.2.4 Claims expire after one year, except for § 478 BGB and damages due to injury, intent, or gross negligence.

9.3 The presence of tartrate crystals (wine stones) is a natural sign of wine quality and maturity.

§ 10 Customer Service

§ 11 Legal Jurisdiction
11.1 German law applies, excluding UN Sales Law.
11.2 For consumers, this applies only if no mandatory protections of the consumer’s residence country are removed.
11.3 For commercial customers, legal disputes shall be settled in the courts of Weinkontor Sommer’s registered location.

§ 12 Miscellaneous
12.1 Contract language is German.
12.2 If any clause of these terms is invalid, the rest of the contract remains in effect. Invalid provisions will be replaced by applicable legal regulations.
